The rules of the road for jobyweeks.com. Read once, agree once, and we both move on.
By accessing jobyweeks.com (the “Site”), you accept these Terms of Service (“Terms”) in full. If you do not accept any part, do not use the Site. The operator is the Free Joby Campaign / Weeks Initiative (“we,” “us,” the “Campaign”).
The Site is an advocacy and educational resource concerning the federal criminal case of Jobadiah Sinclair Weeks (“Mr. Weeks”) and the broader public-interest issues surrounding it. The Site presents a perspective. Statements, characterizations, and opinions reflect the viewpoint of the Campaign and its contributors. Public officials, prosecutors, judges, and other named individuals are referenced in the context of public proceedings and the public record.
Nothing on this Site is legal advice, financial advice, tax advice, or any other form of professional counsel. Use of the Site does not create an attorney-client, fiduciary, or any other professional relationship.
The Site is intended for users 18 years of age or older. Minors may use the Site only with parental supervision and consent.
Content on the Site — including without limitation case timelines, legal characterizations, asserted facts, opinions, descriptions of court proceedings, biographical material, and quoted statements — is provided for informational and advocacy purposes. We make no warranty, express or implied, that any content is accurate, complete, current, or fit for any particular purpose. You agree to verify any factual matter independently before relying on it.
The Site embeds and links to content hosted by third parties (YouTube, Spotify, GiveSendGo, Change.org, Rumble, Wikipedia, news outlets, government domains, and others). We do not control, endorse, or guarantee the accuracy of third-party content. We disclaim all liability for it. Following a link off the Site means leaving our domain; the destination's terms and privacy practices govern.
Excerpts of journalistic and editorial content reproduced on the Site are presented under the fair-use doctrine of 17 U.S.C. § 107 for purposes of commentary, criticism, news reporting, and educational use related to a matter of public concern. If you are a rights holder and believe a particular use exceeds fair use, see the DMCA section below.
If you submit content (testimony, story, image, video, message, claim) to the Campaign through any channel, you grant the Campaign a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content for any lawful purpose related to the Campaign. You represent and warrant that you own or have all necessary rights to the content and that the content does not violate any third-party right or law. You release the Campaign from any claim arising out of the use of submissions.
Donations made through linked third-party platforms (such as GiveSendGo) are: (i) not tax-deductible unless the receiving entity has independently obtained tax-exempt status and the platform indicates the contribution is to such an entity; (ii) generally non-refundable; (iii) used at the Campaign's sole discretion for legal defense, communications, and related campaign expenses; and (iv) subject to the terms of the platform processing the transaction. The Campaign does not custody or process donations directly through the Site.
All Campaign-original content (text, design, layout, graphics, logos, sound recordings, and video) is the property of the Campaign or its licensors and is protected by U.S. and international copyright, trademark, and other laws. You may quote brief excerpts with attribution for non-commercial discussion. All other use requires written permission.
You agree not to:
The Site is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise. The Campaign disclaims all warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, currency, completeness, and title. No oral or written information obtained from the Campaign creates any warranty not expressly stated herein.
To the maximum extent permitted by applicable law, in no event will the Campaign, its operators, volunteers, contributors, counsel, agents, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages; for lost profits, lost revenue, lost data, business interruption, or loss of goodwill; or for any damages in excess of one hundred U.S. dollars ($100.00) in the aggregate, regardless of the theory of liability (contract, tort, strict liability, statute, or otherwise) and even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless the Campaign and its operators, volunteers, contributors, counsel, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:
The Campaign reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with the Campaign in asserting any available defenses.
If you believe content on the Site infringes your copyright, send a notice to heath.bennett82@gmail.com with: (i) your physical or electronic signature; (ii) identification of the copyrighted work; (iii) identification of the allegedly infringing material and its location on the Site (URL); (iv) your contact information; (v) a statement of good-faith belief that use is unauthorized; and (vi) a statement under penalty of perjury that the information is accurate and you are authorized to act for the rights holder. We will respond in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512.
The Campaign makes no representation, warranty, or prediction concerning the outcome of any pending or future legal proceeding involving Mr. Weeks or any other individual. Nothing on the Site should be construed as predicting how any court, executive authority, or other body will act.
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. The federal and state courts located in Denver County, Colorado will have exclusive jurisdiction over any dispute not subject to arbitration.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site that is not resolved through informal negotiation will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Denver, Colorado, in the English language. Each party will bear its own arbitration costs except as otherwise provided by AAA rules.
You and the Campaign each agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Equitable claims for trademark, copyright, or trade-secret infringement may be brought in court at the Campaign's election.
Any claim arising out of or related to the Site or these Terms must be filed within one (1) year after the cause of action accrues, or be forever barred.
You may not assign these Terms without our prior written consent. We may assign at any time without notice.
If any provision is held unenforceable, the remainder remains in full force and effect, and the unenforceable provision will be reformed to the minimum extent necessary to be enforceable. Our failure to enforce any right or provision is not a waiver of that right or provision.
These Terms and the Privacy Policy constitute the entire agreement between you and the Campaign concerning the Site and supersede all prior or contemporaneous agreements.
We may modify these Terms at any time, with or without notice. The “Effective” date above will reflect the most recent revision. Continued use after changes constitutes acceptance.
